General Terms & Conditions
These General Terms & Conditions govern relations between the company ATELIER MAITRE ALBERT with capital of 44080 euros and with its registered office in Paris 75017, registered with the no. FR91622060218 RCS, operating the restaurant Atelier Maître Albert (referred to hereinafter as the “Company”), the first party, and any natural or legal person wishing to make a booking with the restaurant Atelier Maître Albert (referred to hereinafter as the “Client”), the second party.
The Client expressly acknowledges having read and being bound by these General Terms & Conditions by ticking the box “I agree to the General Terms & Conditions” as part of the online booking process.
Article 1: Subject
The purpose of these General Terms & Conditions is to determine the conditions under which the Client is able to submit an online booking request using the booking system that is accessible on the website http://www.ateliermaitreabert.com/, with the aim of benefitting from the restaurant services offered by the restaurant Atelier Maître Albert located 1 rue Maître Albert, 75005 Paris.
Article 2: Booking procedure
Online bookings will be made using the form that can be accessed at the address http://www.ateliermaitreabert.com. It is the responsibility of the Client to complete all the aforementioned form’s fields and to state the date on which he/she wishes to benefit from the restaurant services as well as the service (lunch – dinner), time and number of diners.
Should the date requested not be available, if possible, the booking service may offer him/her an alternative, which it is the responsibility of the Client to ask, accept or decline.
Following acceptance of the reservation, the Client will receive a confirmation summarising the details of his/her booking request (date, service, time, number of diners, etc.) via the e-mail address he/she has provided. It is the responsibility of the Client to check the details appearing in this confirmation and, if necessary, to make the Company aware of any errors made during the booking process as soon as possible.
In the event that the Client should not receive an e-mail confirmation of his/her booking, he/she should contact the Company as soon as possible.
The Client will pay the bill corresponding to the services provided by the restaurant Atelier Maître Albert directly and in full in situ, on the date stated when making his/her booking.
Article 3: Cancellation
All cancellations of bookings must be made at the latest 24 hours prior to the scheduled booking date and time. After this period of 24 hours, cancellation will not be possible.
In order to cancel a booking by the aforementioned deadline, the Client can:
- send an e-mail to the address ateliermaitrealbert@guysavoy.com (with the date and time of sending the e-mail acting as proof) stating the details of his/her booking (name, date, time and number of diners)
- call on + 33 (0) 01 85 15 22 87, giving the name, date, time and number of diners covered by the booking.
Article 4: Penalties
Should the Client fail to attend the restaurant on the date and at the time scheduled for his/her booking and should the booking not have been cancelled in accordance with the conditions outlined in article 3 above, the Client could be subject to a penalty of €50 per person.
Article 5: Liability and guarantee
Except in cases of force majeure, the Company undertakes to provide the restaurant services at the restaurant Atelier Maître Albert for the number of diners, on the day and at the time appearing in the booking confirmation sent to the Client by e-mail, in accordance with the provisions of article 2 above.
The Company may not be held liable in any way for the Client’s failure to attend the restaurant on the day and at the time appearing in the related booking confirmation, including, but not limited to, as the result of an oversight (forgetting), an error in the booking date or time, a failure to receive the booking confirmation, etc.
The information appearing on the website http:// www.ateliermaitreabert.com relating specifically to the price and content of menus, as well as the photographs it contains, are purely indicative and do not represent a contractual commitment.
Article 6: Confidentiality and use of personal data
Information gathered using the booking form is processed electronically by the Company to enable online bookings to be taken for the restaurant Atelier Maître Albert.
The recipients of data are the Company, it being understood that data may be passed on to any other Guy Savoy Group company for the sole purpose of business development by Guy Savoy Group companies.
Pursuant to the French Data Protection Act of 6th January 1978, the Client benefits from a right to access and require rectification of information relating to him/her (See “Personal Data Protection Charter“ below). To exercise this right and to obtain information relating to him/her, the Client must contact the company SERVICE ET CONSOMMATION – Service Client – Monnaie de Paris – 11 quai de Conti – 75006 Paris - France.
Article 7: Settlement of disputes
These General Terms & Conditions are governed by French law. All disputes between the Company and a Client who is a legal person, relating to their implementation and the consequences thereof, will be heard by the competent courts in Paris to which the Parties expressly allocate jurisdiction, including in the event of emergency proceedings, third party appeals or multiple respondents

Definitions
"Supervisory authority" means an independent public authority which is established by a Member State and which oversees the processing of personal data. The supervisory authority in France is the National Commission for Information Technology and Civil Liberties (Commission Nationale de l’informatique et des Libertés - CNIL).
"Collecting" is the act of gathering personal data. This collection can be carried out, in particular, using questionnaires or online forms.
"Consent": Your consent is any freely given, specific, informed and unambiguous indication, via a statement or a clear affirmative act, that you agree to the processing of personal data relating to you.
"Personal data" means any information relating to an identified or identifiable natural person, who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
"Right of access" means all the fundamental rights as described in the European regulation, concerning: the right to be informed; the right of access; the right of rectification; the right of erasure or the right to be forgotten; the right to data portability; the right to object; the right to restriction of processing; the right to establish guidelines on the storage, erasure and communication of your own personal data.
"User" here means any user of the internet network accessing the Restaurant's websites.
"Controller" is the person or organisation that, alone or jointly, determines the purposes and means of processing your personal data.
"Data controller" is the person or organisation that, alone or jointly, determines the purposes and means of processing your personal data.
"GDPR" means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
"Processor" means the entity which processes personal data on behalf of the controller.
"Third party" means any natural or legal person other than the Restaurant, you or the processor.
"Processing of personal data" means any operation or set of operations which is performed on your data, whichever online platform or process is used.
"Restaurant" in this Charter refers to the Restaurant Guy SAVOY and its other premises: Le Chiberta, Les Bouquinistes, l’Atelier Maître Albert.
The User may provide certain personal data by completing forms presented to him or her. This information will be used for managing the Restaurant's business (online reservations, online shop, gift boxes, etc.) and for the Restaurant's promotional activities. It may be disclosed to processors or to third parties in order to process your records or to satisfy legal and regulatory obligations.
Our commitment
With this Personal Data Protection Charter, the Restaurant pledges that the collection and processing of personal data in the course of its business, through its websites, will comply with the General Data Protection Regulation (GDPR) and the French Information Technology and Civil Liberties Law of 6 January 1978. It further commits to take every precaution to maintain the protection, confidentiality and security of the personal data provided to it, and to respect the private lives of its users.
Pursuant to the aforementioned regulation, the Restaurant is implementing this Personal Data Protection Charter.
As such, in accordance with the legal provisions currently in force, the Restaurant commits to the following essential principles:
- Transparency: We will provide you with all relevant information on the purposes and recipients of data collected on you;
- Legitimacy and relevance: We will only collect and process the data required for our stated purposes;
- Confidentiality and integrity: We will implement all reasonable technical and organisational measures to protect your personal data against disclosure, loss, alteration or access by unauthorised third parties;
- Storage period: We will only keep your personal and bank account data for as long it is required for the purposes of the processing or for the provision of a specific service or for the period required to fulfil the purpose for which it was collected;
- Right of access for the purpose of amending/erasing your personal data: You have the option to amend or erase your personal data by submitting a request to us to this end.
The Restaurant may occasionally amend or correct this data protection policy. Please consult it regularly to stay up to date with any changes and how they might affect you.
Pursuant to Article 13 of the GDPR, we hereby inform you that the data controller is the company SERVICES ET CONSOMMATIONS – RESTAURANT GUY SAVOY – Customer Services – Monnaie de Paris – 11 quai de Conti – 75006 Paris. Its representative is Mr Guy SAVOY, who can be contacted at the same address.
Your consent
When using the Restaurant's website, you may be asked to consent to the Restaurant collecting, using and disclosing your personal data to other partner entities and sites in accordance with this Personal Data Protection Charter. If you do not consent to the collection, use and disclosure of your personal data in this way, please do not use the Restaurant's websites or those belonging to its brand and do not provide your personal data.
The Restaurant will collect and use your personal data only when it is relevant and legal to do so. Your explicit consent will always be sought for the collection of your data. You are not obliged to consent, but if you choose not to consent, your participation in certain activities may be restricted as a consequence.
Types of data subject to collection and their purposes
We only collect the personal data required to offer our services to you and to improve them. In particular, data could be collected in the following circumstances:
- when you visit our online services and those of partner sites and/or applications, such as Zenchef, La Fourchette and Michelin Restaurant;
- when you make a reservation online, by fax or by phone;
- when you purchase our products (online shop, gifts) and use our services;
- for the distribution of information on our offers and news about the group, as well as for the distribution of newsletters;
- when you arrive at the Restaurant.
We collect direct personal or professional data, such as your surname, forenames, postal address, email address, telephone number and professional contact details.
The company INGENICO, our online payment provider, will collect your bank details, such as your card number, card expiry date and security code when you make a reservation.
The Restaurant may also occasionally request the aforementioned bank details when you make a reservation.
We may also occasionally collect and store less common personal data, such as your profession, your marital status, your country of origin, food intolerances, etc. This data will only be collected and stored by the Restaurant in order to guarantee that you receive quality personalised service in line with our policy as a high-end restaurant. It will not in any event be disclosed for commercial purposes or to third parties.
In accordance with the regulation in force, we never collect any special categories of personal data, meaning data relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data or biometric data for the purpose of uniquely identifying a natural person. Securing your data
Respecting your right to the protection, security and confidentiality of your personal data is our priority.
The Restaurant commits to maintain a secure IT environment and to implement measures appropriate to the degree of sensitivity of your personal data in order to protect your data against any malicious intrusion, loss, alteration or disclosure to unauthorised third parties.
Given that all personal data is confidential, access to any personal data will be limited to Restaurant staff, or service providers acting on behalf of the Restaurant that are required to access the data in order to perform their duties. All persons that have access to your personal data will be bound by a duty of confidentiality and required to respect the Restaurant's Personal Data Protection Charter.
Furthermore, a contract has been entered into with the processing companies that have access to your personal data to ensure that your data are secure and that your rights are respected under the same conditions.

Length of data storage
Please remember that you have the right to have your personal data erased at any time.
If you have not requested that we erase your personal data, your data will only be stored for the period reasonably required to provide our services, improve them and fulfil any applicable legal requirements. This means that we could store your personal data for some time after you have stopped using our services or website. Beyond that, your personal data will be erased from all our databases.
In accordance with our legal obligations, the Restaurant stores your consumer and bank data for the period required for the purpose of the processing or the provision of a specific service or for the period required to fulfil the purpose for which your data were collected.
Storage location and transfer of personal data
The data are stored by the Restaurant at its processing centres or those of its processors, in accordance with French legislation and the European regulation.
In the case of an external processor, our service providers are contractually bound to the Restaurant.
These contracts ensure a high level of confidentiality and require the processors to implement all necessary technical measures on an on-going basis to store the personal data securely.
Your data will always be stored in processing centres in France or in a European Union country.
Our external processors and service providers will only receive your personal data strictly for the purpose of performing the services with which we have entrusted them (for example, website hosting).
These processors will always be based in France or in a European Union country and are required, by virtue of a legally mandated contract, to maintain the confidentiality and security of your personal data and to process your data only according to the Restaurant’s specific instructions.
Some personal data may also be sent to third parties to fulfil legal, regulatory or contractual obligations or to legally mandated authorities.
How to exercise your rights over your personal data
In accordance with the regulation in force, you have the right to access, amend, rectify, erase/be forgotten and object to the processing and disclosure of your personal data, as well as the right to data portability.
You also have the right to request that we provide you with all the data that we hold on you. You can also request that your personal data be erased, corrected, amended or transferred to a third party.
